Hence, where the owners of the lands located at far away places and other states, busy in their respective works, unable to take care of their properties, there is every danger of the land being occupied by the above unsocial elements The land grabbers enter the land and construct some small tin shed or small room and obtain Municipal sanction and get electricity connection by political influence and establish their physical possession. Even if the illegal possession comes to the knowledge of the original owner he will be in helpless condition and cannot face such huge network of political persons and unsocial elements. Moreover, the law of land is in favour of the person who are in physical possession. He cannot restrict such illegal trespasser (Kabja). The owner has to go to the court and get eviction order to evict the trespasser. To get eviction petition it will take approximately 4 to 5 years. The Police will not interfere into this matter citing a reason that this it is a civil case. Untill then the owner has no other option except to contest the case by incurring huge expenses and mental agony. The illegal possession may be categorized into two classes (A) Physical and (B) Documentary i.e. Wrong entries in property documents. A. To Avoid Physical Illegal Possession: To avoid possible Illegal possession (kabja), we will keep a constant vigil on the property by taking photo graphs, videos etc for every 3 months. If there is any apprehension or attempts of illegal trespass upon the land, we will inform the same to you. Upon the above information, the owner of the property may choose to give simple power of attorney (without sale powers) in our favour. Basing on that, we will file cases on their behalf and obtain Injunction orders from the civil court against them. This power of attorney also contains ancillary powers to liaison with Government and semi government departments and private agencies etc in respect of the property enable us to safeguard and protect the property. Additionally on your specific instructions, we protect your land by fencing the land with wall or wires, erecting gate, constructing out house, taking electricity connection, appointing security people to watch the premises, to erect CC cameras etc. It is a good idea of constructing godowns in the open area, as it will not only prevent from kabja, but also you will get some income by way of rents. B. To Keep A Regular Watch On The Revenue Documents : The land grabbers will enter their names in your property documents by colluding with the tahasildar/MRO with an intention to sell the same to third parties. We will keep regular watch on the Revenue Documents whether there are any tampering, illegal insertion of the names of land grabbers or his hench men. We will take photographs or apply for certified copies of the pahany/adangal/saat Bara and other related documents for every 6 months and send the same to the client through email. Our organization will keep a constant vigil and whenever there is tampering in the revenue records we will inform the original owner. The owner may appoint Advocate of his choice or he can engage the services of our organization. To avoid possible Illegal possession (kabja), we will keep a constant vigil on the property by taking photo graphs, videos for every 3 months. If possible arrange CCTV Cameras. If there is any attempts of illegal trespass upon the land, we will inform the same to you. SALE, PURCHASE AND MUTATION OF PROPERTY : The persons who are interested in investing in real estate wants to purchase properties so that their money will be safe as well as their investment will get good returns. We will purchase the property in his favour. Likewise, when he wants to dispose off the property to some third party, we will sell the same to third parties. After sale or purchase of the property, if you chose to transfer your name in the Government records, we will do mutation. LEGAL ILLEGAL SALE OR ILLEGAL OCCUPATION OF PROPERTY : Even a trespasser (illegal possessor of the property) enjoys certain judicial protection against third parties. This protection is given by the law to the trespasser with an intention to avoid violence and chaos between the trespasser and the original owner. But that does not mean that the trespasser is the real owner and having lawful possession. The original owner is always at liberty to evict the trespasser by taking the recourse of court. But the only thing is that original owner should not resort to illegal methods of evicting the trespassers. The original owner has to face a lot of problems to get back his physical possession of the property. It becomes more worse for the owners. Eviction of trespassers is not an easy process and it is a nightmare for the owner. It is an easy work for the Land grabbers to occupy the vacant land or plots. They create some fabricated and forged documents showing them as real owners, with a view to make strengthen their illegal possession. For this purpose they mingle with the Revenue, Police, other Government Authorities and political leaders and the Government Authorities in turn mutually help the land grabbers unofficially. A normal or lay person cannot resist the strong opponent inspite of giving police complaints and approaching courts. Property Fraud is a nuisance for owners who are not able to safeguard their physical possession of the land and unable to control illegal entries in Revenue Records mainly due to negligence and hectic work schedule. Even the Power of Attorney Holders sometimes deceive the owner and collude with the trespassers for their monetary benefits. Hence, we take the position of Power of Attorney Holder and assure the owner our trustworthiness, reliability, honesty. We take responsibility of evicting the trespassers and recovery of physical possession, documentary possession and correction of entries in revenue records, if, any, of the land effected. Upon your specific instructions, we will even file criminal cases against the trespassers and land grabbers. We take care of matters right from authorizing us through Power of Attorney till the actual recovery of the property The fraud may be classified into two classes: A. Fraud by Creating Fake and Forged Documents in Revenue and Government Documents. If the dispute is more aggravate and involves question of title, the RDO will not take up the matter and insist the client to go to the Civil Court for the relief. Then we have to file a civil case. Filing Criminal case against Trespassers. B. Fraud by Taking illegal physical possession (Trespass/Kabja) by Creating Fake and Forged Documents in Revenue and other Government Documents. In this case we will file the following cases. Suit for Recovery of Physical possession and Eviction of Trespassers. Putting representation before the Revenue Division Officer for correction of entries in the revenue records. Criminal case against the Trespassers. Note:- The difference between (A) and (B) is that in Class "A" there is no aspect of physical possession and the fraud is being done only in Revenue and other Government Records. Whereas in Class "B", along with fraud being played in Revenue Records, additionally there is physical possession also. SUCCESSION, WILL, PROBATE, LETTER OF ADMINISTTRATION: When a person dies intestate (without a will), the whole property will be devolved upon his heirs. The deceased might have left movable property by way of Bank Accounts, Fixed Deposits, Share Certificates, Debentures, Insurance Policies etc. The concerned Bank or other officials will not hand over the above property to the legal heirs and insist them to obtain a Succession Certificate from the concerned Competent Court. On an application of the legal heir, a succession certificate will be granted by the concerned civil court to all the legal heirs of a deceased person. The court order helps the legal heirs to realise the debts and securities of the deceased. It establishes the authenticity of the heirs and gives them the authority to have securities and other assets transferred in their names as well as inherit debts. We can represent you on your behalf and help you attain a succession certificate as per Indian Law. PARTITION: Naturally, there may be some disputes and misunderstandings between the legal heirs of the deceased persons. One or more parties may demand for mutual partition. If all the legal heirs mutually distributes the assets, there is no problem. But some of them does not agree for distribution of shares, then the problem arise and the Partition Deed cannot be executed. In those circumstances, any one legal heir can claim the property by filing partition suit before the concerned Court.. Hence, we will file partition suit on behalf of them (for both movable and immovable properties) and take necessary steps to get final decree in his favour. CONSUMER CASES AGAINST BUILDERS: Unfortunately, it is common practice for Builders to delay or completely avoid handing over of built apartments at the prescribed time which results in monetary loss as well as mental stress to the customers. Hence, a Consumer complaint has to be filed in the District Consumer Forum/State Consumer Commission to direct the Builder to deliver the property or refund the money along with interest and damages. For getting Occupancy Certificate, it is taking lot of time and the Builder will not take proper interest in this regard. He will be interested in only how to launch new venture. We will take necessary steps of follow up in the concerned Municipal Corporation/Municipality to get the Occupancy Certificate as soon as possible. not to damage, not to sublet the premises to third parties, to grant arrears of rents and damages. DISPUTES OF LAND LORD AND TENANT: The problems of land lord and tenant are not unknown. In case of persons who reside far away places, it becomes more worse. Tenants take undue advantage of the absence of overseas citizens. The tenants create lot of nuisances i.e. they stop paying the rents, they refuse to vacate, they damage the premises, sub let the premises etc. Serving a notice to quit also does not work. To carry out eviction is a cumbersome process for an overseas citizen. We will file suit for eviction to evict the tenant, we obtain mandatory injunction from the court against the tenant not to damage, not to sublet the premises to third parties, to grant arrears of rents and damages. LEGAL NOTICE MOVABLE AND IMMOVABLE PROPERTY: Legal Notice relating to movable immovable property will be issued by us in the capacity of Advocate in your favour directing the opponent to vacate the property, not to interfere into your land, pay the rents and arrears of rents, partition the property, give divorce, give maintenance, give child custody etc, as the case may be.
